Terms of Service

Effective date: 9 July 2026

These Terms of Service ("Terms") govern your access to and use of WakLog, a service provided by Sisimizi Technologies ("Sisimizi", "we", "us", or "our"), a company incorporated under the laws of Kenya. By registering for or using WakLog you agree to be bound by these Terms.

1. The Service

WakLog is a cloud-based business management platform designed for Kenyan service businesses (salons, barbershops, spas, and similar). It provides service logging, commission tracking, booking management, staff management, goods sales recording, financial reporting, and M-Pesa payment collection ("the Service").

2. Eligibility and Account Registration

You must be at least 18 years old and legally authorised to operate the business you register. You are responsible for the accuracy of all information you provide during registration and for keeping your credentials secure. You are liable for all activity that occurs under your account.

3. Subscription Plans and Payment

WakLog is offered on a subscription basis across three plans: Starter, Business, and Pro. Subscription fees are billed monthly and are payable in advance via M-Pesa or card through our payment gateway. Fees are non-refundable except where required by Kenyan law.

We reserve the right to change subscription prices with 30 days' written notice to your registered email address. Continued use after the notice period constitutes acceptance of the new price.

If payment fails, a grace period of up to 7 days is granted before access is restricted. We will notify you via email and in-app before restricting your account.

4. M-Pesa Client Charging

Business and Pro plan subscribers may collect payments from their clients via M-Pesa STK Push through the PotePay gateway, facilitated by Sisimizi's master merchant account on behalf of each tenant. By using this feature you confirm that:

  • You have obtained your clients' consent to initiate an M-Pesa STK Push to their phone.
  • The amounts charged accurately reflect services or goods rendered.
  • You will not use this feature for unauthorised, fraudulent, or deceptive charges.

Sisimizi is not liable for failed, declined, or disputed M-Pesa transactions. Reconciliation disputes between you and your clients are your sole responsibility.

5. Acceptable Use

You agree not to:

  • Use the Service to process illegal transactions or facilitate fraud.
  • Attempt to reverse-engineer, copy, or resell any part of the Service.
  • Upload content that is defamatory, obscene, or that infringes third-party intellectual property rights.
  • Interfere with the security or integrity of the platform.
  • Use automated scripts to access the Service without our written consent.

We may suspend or terminate your account without notice if we have reasonable grounds to believe you have violated these Terms.

6. Your Data

You retain ownership of all business data you input into WakLog, including client records, staff information, and transaction history. You grant Sisimizi a limited licence to store, process, and display that data solely to provide and improve the Service.

On termination of your subscription, you may request an export of your data within 30 days. After that period Sisimizi may permanently delete your data in accordance with our data retention policy (see our Privacy Policy).

7. Service Availability

We aim for 99% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from downtime, slow performance, or data loss beyond our reasonable control.

8. Intellectual Property

All software, branding, and content comprising the WakLog platform is the property of Sisimizi Technologies or its licensors and is protected by Kenyan and international intellectual property law. Nothing in these Terms transfers ownership of any intellectual property to you.

9. Limitation of Liability

To the fullest extent permitted by Kenyan law, Sisimizi's total liability to you for any claim arising out of or related to the Service shall not exceed the total subscription fees paid by you in the three (3) months preceding the claim. Sisimizi is not liable for indirect, incidental, special, or consequential damages, including loss of profit or data.

10. Termination

You may terminate your account at any time by contacting us at support@waklog.co.ke. Termination does not entitle you to a refund of any fees already paid. We may terminate or suspend your account for breach of these Terms or non-payment after the grace period.

11. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya. We encourage resolution through good-faith negotiation before resorting to litigation.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email and via an in-app notice at least 14 days before they take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms.
